These Terms of Use ("Terms") are an agreement between you and Serhii Kharauzov ("we", "us"), based in Poland, for the Soapy app ("the app") and the website soapyhabit.com. By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. About the app

Soapy helps parents build healthy hygiene habits together with their children, using photos, short animations, a timer, and a companion character. The app is for use by parents, who are responsible for operating it and for supervising its use.

2. Apple terms

The app is licensed to you, not sold. Your use is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, which applies in addition to these Terms. If these Terms conflict with the Standard EULA about the license, the Standard EULA prevails for that point.

Apple is not a party to these Terms and has no obligation to provide maintenance or support for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.

3. License

We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, for personal, non-commercial use, under the Apple Media Services Terms and App Store rules.

You agree not to copy, modify, reverse engineer, decompile, or resell the app, extract its animations, audio, or other content, circumvent the free-routine limit or any subscription check, or use the app unlawfully.

4. Free use and Soapy Plus subscription

The app includes a limited number of free routines. After that, continued use requires a subscription called Soapy Plus.

Purchases require a confirmation step in the app that is intended for adults.

5. Health and safety

Soapy is an educational and motivational tool. It is not medical, dental, or healthcare advice, and it does not diagnose, treat, or prevent any condition. The microbes, animations, and characters are illustrations for motivation and do not show the real state of anyone's health. Follow guidance from your doctor, dentist, or other qualified professional for health matters.

Parents are responsible for supervising their children during all routines, for taking photos safely, and for making sure that the child is safe while washing, brushing, or using the phone. Place your device where it cannot fall, get wet, or be damaged. The timer and song are not a substitute for supervision.

6. Your content

Photos you take or choose in the app are processed on your device and are not stored or uploaded by us, as described in the Privacy Policy. You are responsible for having the right to photograph the people and things you capture. We do not claim any rights to your photos.

7. Our content

The app, its name, the companion character, animations, video clips, audio, music, text, and design belong to us or our licensors, and are protected by intellectual property laws. These Terms give you no ownership of them.

8. Privacy

Our Privacy Policy explains how information is handled. By using the app, you acknowledge it.

9. Availability and changes

We may update, change, or discontinue features, content, or the app, including free and paid features, at any time. We aim to give notice of material changes that affect a paid subscription. The app depends on your device and on Apple services such as the App Store and iCloud, and we do not control them.

10. Disclaimer

To the extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not promise that the app will always be available, error-free, or uninterrupted, or that it will produce any specific result for your family.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for the app in the 12 months before the claim arose. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for intent or gross negligence, and nothing affects your mandatory rights as a consumer.

12. Ending use

You can stop using the app at any time by deleting it and cancelling any subscription. We may suspend or end your access if you seriously or repeatedly breach these Terms. Sections that by their nature should continue after termination will continue to apply.

13. Governing law and disputes

These Terms are governed by the laws of Poland, without affecting the mandatory consumer protection rules of the country where you live. If you are a consumer, you may bring a dispute in the courts of your country of residence, as the law allows. Within the EU, the European Commission's online dispute resolution platform may also be available to you.

14. Changes to these Terms

We may update these Terms. The date at the top shows when they last changed. If you keep using the app after a change takes effect, you accept the updated Terms. For significant changes, we will tell you in the app or on the website.
